TO THE EXTENT PERMITTED BY LAW, BY USING THE SERVICES, YOU ARE AGREEING TO ARBITRATE DISPUTES AGAINST BLUE ROW CAPITAL IN YOUR INDIVIDUAL CAPACITY, AND YOU ARE WAIVING YOUR RIGHT TO ACT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You must comply with all applicable laws and regulations related to trading and financial activities in your jurisdiction.
You are solely responsible for all applicable taxes payable as a result of your activity in connection with, and your use of, the Services.
You are responsible for maintaining the confidentiality of your account information, including your password, and are responsible for all activity associated with your account. You are also responsible for ensuring that all data you provide to us is accurate and up-to-date. Any false representation, including the provision of a fake or unauthorized name, is a violation of these Terms. You agree (i) to notify us immediately of any unauthorized use of your account or any other security breach, and to (ii) report and correct any discrepancies or errors in your data promptly.
You acknowledge that participation in our trading programs is not an offer or solicitation of any kind in any jurisdiction where we are not authorized to do business or where such offer or solicitation would be contrary to the local laws and regulations of that jurisdiction.
Unless otherwise expressly permitted by Blue Row Capital, you are restricted to creating a single account on our Platform. Creating multiple accounts may lead to termination of all related accounts and forfeiture of any associated profits.
You are permitted to use the Services for your own personal, non-commercial purposes. We authorize you to view, print, and copy the materials on this website solely for your personal, non-commercial use, provided that (i) no copyright, trademark and/or service mark notices or disclaimers therein are excluded, modified or obscured on any copy of all or a part of such content and (ii) you otherwise comply with these Terms.
You must engage in ethical trading practices, avoiding any strategies or actions that exploit or manipulate the simulated trading environment. Violations will be subject to our review and potential termination of service.
In addition to other prohibitions as set forth in these Terms, you are prohibited from using the Services: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload, store or transmit viruses or any other type of malicious code that will or may be used in any way that will disrupt or otherwise affect the functionality or operation of the Website; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to circumvent, disable or otherwise interfere with the security-related features of the Website. We reserve the right to terminate your use of the Services for violating any of the prohibited uses. Illegal activities conducted through use of our Services may be reported to relevant authorities.

You hereby acknowledge that trading involves significant risk and that there is a possibility of losing all funds deposited with Blue Row Capital. You agree to assume all risk associated with trades conducted through our Platform and will not hold us liable for any losses incurred.
We offer various subscriptions in connection with our Platform, as specified in the respective subscription plan. Subscriptions are available on a recurring basis, with the standard duration being thirty (30) days unless otherwise stated.
Subscriptions to our services will automatically renew at the end of each subscription period, and users will be automatically billed for the subsequent period. You are responsible for understanding the renewal dates of your subscriptions and can view these details within your account settings.
You agree to pay all applicable fees related to your use of the Services using accepted payment methods. By subscribing to our Services, you authorize Blue Row Capital to charge your provided payment methods for these subscription fees.
You are responsible for all charges incurred under your account, whether made by you or another person using your account. If we do not receive payment for subscription fees from the payment method you provided, you agree to promptly pay all amounts due upon demand by Blue Row Capital.
You assume the risk of your reliance on the material provided through the Services.

Moreover, occasionally information on the Website and on the Platform may contain typographical errors, inaccuracies or omissions. Termination may result in account closure, forfeiture of all funds and balances, and potential banning from our services. If we terminate your license to use the Services, these Terms will continue to apply.
We do not guarantee, represent or warrant that your use of the Services will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the Services will be accurate or reliable.
You expressly agree that your use of, or inability to use, the Services is at your sole risk. THE
SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT
ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER
EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL BLUE ROW CAPITAL, OR ANY OF ITS SUBSIDIARIES, AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS,
CONTRACTORS, SUBCONTRACTORS, SUPPLIERS, SERVICE PROVIDERS OR LICENSORS, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT,
INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, TRADING LOSSES (INCLUDING BUT NOT LIMITED TO LOSSES CAUSED BY HARDWARE OR SOFTWARE FAILURE, COMMUNICATION
LINE FAILURE, UNAUTHORIZED ACCESS, THEFT, OPERATOR ERRORS, SEVERE OR
EXTRAORDINARY MARKET CONDITIONS, OR OTHER CAUSES COMMONLY ASSOCIATED WITH FUTURES TRADING), REPLACEMENT COSTS, OR ANY SIMILAR
DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, INCLUDING, BUT NOT LIMITED TO, ANY
ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY
KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT POSTED, DISPLAYED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. BECAUSE SOME STATES OR
JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
The Blue Row Capital name and logo are trademarks of Blue Row Capital (collectively the "Blue Row Capital Trademarks"). Other company, product, and service names and logos used and displayed on the Website and/or on the Platform may be trademarks or service marks of third-party owners who may or may not endorse or be affiliated with or connected to Blue Row Capital. Nothing contained on the Website or Platform should be construed as granting, by implication, estoppel or otherwise, any license or right to use the Blue Row Capital Trademarks or any such third-party marks without our written permission or the permission of such other party who may own such mark(s).
The contents of the Services, including but not limited to, works of authorship, text, articles, blogs, data compilations, software, design, graphics, illustrations and artwork (collectively, "Materials") used herein are the copyrighted property of Blue Row Capital (or the original creator of the material) and are protected under applicable intellectual property laws, regardless of whether such Materials are registered. Blue Row Capital is not responsible for evaluating the content or accuracy of, and makes no claim or warranty of, and is not liable or responsible for, any information found in third-party materials or a linked website or social media platform.
Blue Row Capital is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review the third party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.
You agree to defend, indemnify, and hold harmless Blue Row Capital and its subsidiaries, affiliates, partners, officers, directors, officers, employees, agents, contractors, subcontractors, service providers, subcontractors, suppliers, service providers and licensors, from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, made by any third party due to or arising out of your use of or reliance on the Services, any Blue Row Capital or third-party content, your misuse of the Services, or your breach of these Terms.
Any and all controversies, disputes, demands, counts, claims, or causes of action (including the interpretation and scope of this clause, and the arbitrability of the controversy, dispute, demand, count, claim, or cause of action) arising out of or in any way related to these Terms (a "Dispute") between you and Blue Row Capital or its successors or assigns shall exclusively be settled through binding and confidential arbitration, unless earlier resolved in accordance with the Pre-Arbitration Dispute Resolution process described below.
In the event of any Dispute arising between you and Blue Row Capital, one party must first send a written notice of the Dispute to the other party by email with a delivery receipt requested ("Notice"). Our email address for Notice is [email protected]. The Notice must describe the nature and basis of the Dispute and set forth the specific relief sought (the "Demand"). The parties shall first meet and confer by such method as the parties may mutually agree, to attempt to resolve the Dispute. The parties shall work together in good faith to attempt to resolve the Dispute directly for thirty (30) days after the Notice is received, or such further period as the parties may mutually agree. If the Dispute is not resolved by the end of such thirty (30) day (or longer) period, then either party may commence arbitration, as further described below.
Any dispute, claim, or controversy arising out of or relating to these Terms, including the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this Agreement to arbitrate, shall be resolved by final and binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures, conducted by one neutral arbitrator in Fort Worth, Texas. Judgment on the award may be entered in any court having jurisdiction. The parties shall evenly share the costs of arbitration.
This arbitration provision shall not preclude either party from seeking provisional, interim, or injunctive relief in aid of arbitration from a court of appropriate jurisdiction prior to or during the arbitration process.
In any arbitration or litigation concerning these Terms, the prevailing party shall be entitled to recover all costs, fees, and expenses incurred, including reasonable attorneys' fees. The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could grant, provided that punitive damages shall not be awarded.
The parties agree that:
● No arbitration proceeding shall be certified as a class action or proceed on behalf of the general public, other users, or similarly situated persons;
● No arbitration proceeding shall be consolidated or joined with any other arbitration proceeding; and
● All disputes must be arbitrated on an individual basis, and each party expressly waives any right to participate in a class action.
The parties shall maintain the confidentiality of the arbitration proceedings and award, including the hearing, except as necessary to prepare for or conduct the arbitration, or as required by applicable law or judicial decision. The provisions of this Section may be enforced in any court of competent jurisdiction, and the parties submit to the personal jurisdiction of the courts in Fort Worth, Texas for purposes of enforcement.
To the fullest extent permitted by applicable law, you agree that ANY CLAIMS YOU BRING
AGAINST BLUE ROW CAPITAL MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED
CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT
CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS, MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING, AND MAY NOT AWARD CLASS-WIDE RELIEF. YOU ACKNOWLEDGE THAT YOU ARE GIVING UP THE RIGHT TO PARTICIPATE IN A CLASS OR JURY TRIAL VOLUNTARILY AND KNOWINGLY, AND THAT THIS IS AN ESSENTIAL CONDITION OF ACCESSING THE WEBSITE AND SERVICES.
If the foregoing class action waiver is found to be unenforceable for any reason, the remainder of this Dispute Resolution provision shall also be unenforceable.
You consent to receive electronic communications from Blue Row Capital and agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing.
If any provision of these Terms is determined to be unlawful, void or unenforceable, such provision: (i) shall be deemed to be severed from these Terms and enforceable to the fullest extent permitted by applicable law, and (ii) shall not affect the validity and enforceability of any other remaining provisions.
We may assign these Terms at any time to a subsidiary, affiliate or parent company or to a successor to our business as part of a merger, consolidation or sale of all or substantially all of our business. You may not assign or transfer your rights or obligations under these Terms.
These Terms and our Privacy Notice constitute the entire agreement between you and Blue Row Capital with respect to the Services and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, with respect to use of the Services. A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
These terms and conditions will be governed by and interpreted pursuant to the laws of the State of Texas without regard to any conflicts of law principles.
Subject to the arbitration provisions herein, the parties agree that any action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Fort Worth, Texas. You hereby submit to the personal jurisdiction of such courts and waive any objection to venue or inconvenient forum.
